    WisDOT’s Trans 123 has resurfaced, with a final draft having been submitted to the legislative committee.

    The proposed rule will ban registration of post-1967 25+ year-old grey-market import vehicles, which is currently permitted under Wisconsin law.

    Federal law allows import of these vehicles, but Wisconsin thinks they are unsafe and seeks to keep them from Wisconsin’s roads.

    Today I received the following notice from WisDOT:

    Here is a bit of WisDOT’s summary:

    “That is, even though federal law allows 25 year old vehicles that do not meet FMVSS (for the vehicles year of manufacture) to be imported lawfully into this country, Wisconsin will not register them for use on public roads.” (Pg. 4)

    “This rule does not apply to any vehicle for which a statutory registration category exists in ch. 341, Stats., including homemade, reconstructed, replica, or street modified vehicles that are eligible for registration under s. 341.268, and former military vehicles that are eligible for registration under s. 341.269 or s. 341.266(2)(a).” (Pg. 3)

    I spoke yesterday with Ian from Sen. Holperin’s office. This is still not a “done deal”. Unless he decides by Friday to hold a Public Hearing, DOT’s rule goes into effect.

    Call Sen. Holperin’s office today and politely request that they hold a Public Hearing over Trans123.

    Hard to. As a Republic, State rights and laws trump Federal on many levels. I’d have to think this is one of them. Since Fed money is used on the roadways….

    Way above my pay grade to know but I’d have to think this is similar to California’s CAFE laws.

    This just in from the Capitol. They WILL hold a Public Hearing on TRANS-123

    The date is not yet set. Congratulations and THANKS to all who helped persuade our legislators to do this!

    Obviously, the battle is not over yet. But this is a huge step, especially during a reelection campaign, where many folks are really busy fighting for their jobs.

    I was advised that we need a “TON” of people to show up at the Public Hearing. We can do this.

    To answer a couple previous questions. States can enact laws which are more strict than Federal regulations require, much as California has done. But Wisconsin has not yet enacted such laws, nor Administrative rules – like Trans-123. If Trans-123 does go through, the only way to undo it will be through another Administrative rule change or by getting a law passed – neither one of these would be easy, in fact it’s damn hard.

    Now is our opportunity to make sure WisDOT does not shove this moronic rule up our ***.

    I’ll post the date ASAP. If you don’t do anything else to help our hobby out this year, GO TO THE PUBLIC HEARING AND OPPOSE TRANS-123!

    After making some inquiries I received the response below.

    Please reserve the date on your calendar and ask for time off from work if necessary.

    We need to have a huge presence at the public hearing!

    Public hearing: 10am on September 22nd in room 412E of the State Capitol

    I will make up a petition which can be circulated for those who cannot make it.

    Just got off the phone with the Steinbrink office – there will be a public hearing at 10am on September 22nd in room 412E of the State Capitol. The Joint Transportation Committee will hold the hearing, and hopefully this will be the ideal arena to reach a workable compromise on the proposed rule change. Let me know if you have any questions, otherwise thanks for your dedication to this issue – it definitely helped spur the committee hearing – and keep in touch as the 22nd approaches.

    As you may know the Assembly and Senate Transportation Committees WILL hold a public hearing next week. The details are below!!!

    Please attend the public hearing and share your testimony with the committee. Bring 20 written copies of your testimony for the committee members. If you do not like this CLEARINGHOUSE RULE (CHR 09-044 – TRANS 123 is a rule not legislation) then you want the committee to reject the rule.

    Thanks to all you guys who are helping out in this. I talked to another neighbor yesterday who cannot make the hearing, but he’s writing to them.

    I’m assuming that, like me, many of you may not actually own a car yet affected. The fact that you’re stepping up to stand with those guys who do says a lot.

    The single best thing we can do to combat someone taking away our rights is to stand united against them.

    If there’s any doubt about the seriousness of this matter, please read this, just in from a local hot-rodder: (This was originally in the form of replies to emails, I think.)

    Hot Rod Gloom? We should maybe come to the party, Boys.
    On one hand, there is a disconnect between the intent of Law and
    individual gov’t employees’ enforcement of it.
    The laws are bad enough, right? Witch hunts. Chicken Little. Gestapo.
    Are some of them actually zealously over-enforcing in order to ‘justify’
    and pay for their gov’t jobs? Tsk.Tsk.
    The fall guys are individual groups like motorsports afficianados- easy targets –
    who appear to be gross violators, criminals, in the victimless crime of
    driving old cars.
    But it’s worse when the legislator discriminates against our community.
    There’s an elected female State official down San Diego way who has been quoted saying
    she wants us off the highway, and want us to pay for the priviledge of trailering them
    to whatever show or parade we take them to.

    Here’s what we read:

    “In speaking with Senator Christine Kehoe from the San Diego area she flat out said,
    WE WANT YOUR CARS REGULATED, WE WANT A MILEAGE CAP ON YOUR CARS, WE WANT YOU TO HAVE TO
    PURCHASE A PERMIT TO DRIVE THEM AND WE WANT YOU TO TRAILER YOUR CARS TO AND FROM YOUR EVENTS.
    When she was asked, “What about a guy that wants to drive the Route 66 to Chicago and back?’
    Senator Kehoe’s response was, THEY BETTER HAVE A TRAILER WAITING FOR THEM WHEN THEY RE-ENTER CALIFORNIA.”

    See, Chuck went to the ‘California Association of Car Clubs’ meeting, which was attended by CHP, a state Senator or two, a CARB rep or something,
    and he came away knowing that…if we don’t mobilize now…it’s over.
    The stated goal of the politicos and their over-reacting self-interested state employees is to eliminate collector cars from the road. Period.

    “On Sept. 1, 2010, a law was passed requiring all automobile service providers to check the tire pressures of every vehicle being maintained or
    repaired at their facility. The regulation, issued by the California Air Resources Board, applies to auto maintenance/repair providers
    but not to auto parts distributers/retailers, auto body/paint facilities, auto glass installers or wreckers/dismantlers,
    according to a press release from SEMA. (SEMA – Specialty Equipment Manufacturers Association is a trade organization representing auto service providers.
    They notified their membership of this new law by way of this press release. CK)
