    LRB 3267/1 is a bill being introduced into the Wisconsin Legislature to protect your right to drive the vehicle of your choice.

    SHORT DEADLINE: Thursday, February 9, 2012.

    Currently Wisconsin offers many ways to register vehicles; regular, hobbyist, collector, farm, etc. Many types of motor vehicle registration impart operating restrictions ranging from regular registration, which is minimally restrictive, through HMV registration in which a vehicle can only be used to and from special events.

    Up until a few years ago Wisconsin residents enjoyed the freedom to own and proudly drive on the roads their vehicle of choice. Due to WI DOT cutting budgets and nonsensical internal philosophies, the agency has been relying more and more on their computer technology to cut corners. This is very problematic when dealing with the large variety of vehicles on the road today.

    Many citizens are being improperly denied the registration of their choice based on such insignificant factors as a radio, color, or hubcaps. I found that most of the problems stem from the WI DOT’s interpretation of prohibitions based on vehicle condition or equipment and in many cases the citizen’s options for proving compliance are limited or impossible. In other cases, vehicles that were previously registered here in Wisconsin are now being denied registration upon change of ownership.

    WI DOT’s actions have adversely affected citizens, and have had a detrimental impact on the agricultural, forestry, construction, and automotive industries. Their actions have also lead to multiple costly as well as time consuming appeals and ongoing problems for constituents.

    This bill was created to address numerous citizen concerns as to the registration of motor vehicles in Wisconsin.

    LRB 3267/1 Does the Following:

    Repeals a state statute that contains an obsolete reference in law, and has created confusion and misapplication.

    Repeals a statute that has taken legally-complying vehicles off the road.

    Prevents monetary losses to citizens encountered when a formerly-legal vehicle is reduced to non-highway-legal status for the sake of clerical convenience within the department.

    Gives residents the ability to have second chance if the DOT denies registration. The bill repeals two prohibitions which were problematic for motor vehicle owners and instead applies an existing inspection procedure to determine minimum applicable standards to make a vehicle eligible for regular registration. This bill still allows the DOT to deny registration if they have concerns about vehicle condition or equipment, but in the event the application is denied; LRB 3267/4 provides a simple and low-cost way for the owner to verify compliance with the requirements.

    Reduces fiscal impact by the citizen bearing the cost of an inspection versus the state employees expending substantial time and resources to determine eligibility.

    Makes a change to the requirements for collector car registration by allowing vehicles which have been minimally modified (such as for improved safety or drivability) to register as a collector, so long as they do not substantially alter the vehicle. Thus, remaining true to the intent of the collector plate registration.

    Congratulations:

    SB-462/AB-580 was “concurred in” by the Assy. on Friday. With the previous vote in the Senate, we believe the bill will now go before Gov. Walker.

    Everybody’s efforts seem to be paying off!

    UPDATE

    SUCCESS IN THE LEGISLATURE!

    The Wisconsin legislature passed the repeal of 341.10(6m) on Friday.
    It now just needs Gov. Walker’s signature to become LAW.

    This will restore regular registration for all 1969 and older ex military vehicles.

    WHAT IS NEXT?

    We are now in the process of arranging a meeting with DOT to discuss the other issues that you expressed support for.

    The list of items that are to be considered as modification by the DMV when processing Collector Plate applications.

    The requirement that the manufacturer certification label remain intact 341.10(6). We hope that DOT will make an interim policy change as we cannot amend this statute until the next session.

    ANNOUNCING BIG GAINS FOR OWNERS OF FORMER MILITARY VEHICLES

    In discussions with DOT, Tom has secured the following agreements.

    Effective Immediately: ANY former U.S. military vehicle under 10,000 GVW may register for regular registration regardless if there is a certification label.
    Effective Date (approx 7/1): All Pre-1970 former military vehicles (US and foreign) may register for regular registration; (Auto, Truck, Farm, Collector, Hobbyist, etc.)
    Confirmation of problem: 1970 & newer former military vehicles which lack a certification label may still be denied registration under 341.10(6), a problem which can only be corrected through legislation. (see the next item)

    BIG GAINS FOR ALL VEHICLE OWNERS

    Going Forward: DOT has acknowledged the need to draft legislation to amend 341.10(6). The way it’s written now, any vehicle without a certification label can be denied registration, including every pre-’70 vehicle. It will be changed, to acknowledge the federal exemption for vehicles older than 25 years. We expect to draft legislation this year, and will push for passage next year. STAY TUNED.

    ANNOUNCING BIG GAINS FOR OWNERS OF COLLECTOR VEHICLES (NOT HOBBYIST)

    Note: These changes will not effect HOBBYIST registration *.
    As you are aware, Collector registration has recently been denied over trivial items such as radios or hubcaps. When we previously asked your opinion about such changes, the response was overwhelmingly in favor of allowing minor modifications to Collector vehicles while still staying true to the spirit of an original or historic vehicle.

    In discussions with DOT, Tom has secured the following agreements.
    Effective Immediately:
    DMV will apply as much leniency as possible in deciding which vehicles qualify for Collector registration.
    Going Forward: DOT wants a specific list of changes which cannot be considered when deciding originality, and will help draft and introduce legislation for next year.

    You Can Help, by submitting your ideas for this list to us. (These are things that you think DMV should overlook on a Collector vehicle application.)
    Here are some of our ideas: Wheels/Tires, Color, Radio/Sound System, Safety Upgrades (ie. safety glass windows, dual circuit brakes, radial tires), original options…
    We plan to set up a webpage where you can register for or against the items. We’ll share the results with you and the DOT.

    * Please Note – HOBBYIST: Some owners of Hobbyist vehicles opposed the original bill, stating that Hobbyist owners did not wish those laws to change. In response, we are not proposing any changes to Hobbyist registration laws. Until and unless Hobbyist owners raise concerns and problems which they wish this group to address, we will not go there.

    THE FUTURE OF THIS E-MAIL GROUP

    This Email goes out to owners, clubs, businesses, farmers, organizations, etc. who share a common interest in preserving old vehicles of all sorts. By forming this email group, and by everybody acting united, we have succeeding in getting this bill passed. In doing this, we have created enough political power to support each others’ causes.

    It was critical to get at least a part of the bill passed because that validates the power of this group. In order to do that, the bill was stripped down to just the repeal of the military vehicle ban and it ended up directly benefiting only a small segment of our group: owners of former military vehicles. Those owners understand that others have contributed to their gain, and you can be sure they are anxious to repay that effort. But the bill did much more than that, because it proved to DOT and to Legislators that we are a powerful group. Now we have their attention and we are working on getting the rest of our concerns dealt with.

    Our political strength comes from all of us working together.

    Remember Who Helped Us! Sen. Glenn Grothman and Assy. Rep. Evan Wynn were responsible for this Bill getting introduced and they voted for it! They deserve your THANKS, and please remember them when it comes time to place your vote. Rep. Wynn is up for re-election soon, and he’s a terrific guy. Pass the word.

    IT’S OFFICIAL. GOV. WALKER SIGNED OUR BILL INTO LAW YESTERDAY. SB-462 is now 2011 Wisconsin Act 235.

    AS WE WROTE PREVIOUSLY, WE WILL CONTINUE TO WORK WITH DOT FOR PASSAGE OF THE OTHER PROVISIONS WHICH WERE NOT INCLUDED IN THIS BILL *:
    RE-WRITE s.341.10(6) TO REFLECT FEDERAL LAW, SO VEHICLES OLDER THAN 25 YEARS ARE NOT DENIED REGISTRATION FOR LACK OF A CERTIFICATION LABEL.
    AMEND COLLECTOR PLATE RULES TO ALLOW FOR MINOR MODIFICATIONS.

    STAY TUNED AS THESE CHANGES MOVE FORWARD.

    We’ve just learned that the “effective date” for the newly passed 2011 Wis. Act 235 will be July 2, 2012.

    This means that beginning July 2, all pre-’70 (Oct. 1, 1969) former military vehicle, U.S. & foreign, may register for normal registration options. This includes all weight vehicles. (As always, a title or SF-97 is required, and as always, compliance with Wis. Equip. standards is a condition of operation. Just like civilian vehicles, Fed. Motor Carrier Safety Admin. rules apply to larger commercially used vehicles.)

    Also remember that currently, ANY former U.S. military vehicle under 10,000 GVW may register for regular registration regardless of year, and regardless if there is a certification label.

    We will be meeting with DOT this summer, to address vehicles over 10,000# gvw which are 1970 or newer. We’ll keep you posted as this moves forward.
